Overview
Marked Management respects the intellectual property rights of others and expects our users to do the same. Since our platform allows users to upload and publicly display tattoo photos and other creative work, we take copyright seriously.
This policy describes our process for handling copyright complaints under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We have registered a Designated Copyright Agent with the U.S. Copyright Office as required by law.
Important context: Tattoo art is a particularly complex area of copyright law. Tattoo artists may own copyright in their designs, and photographs of tattoos may implicate multiple rights holders. If you have questions about tattoo-specific copyright issues, we encourage you to consult a qualified attorney.
Submitting a DMCA Takedown Notice
If you believe content on Marked Management infringes your copyright, you may submit a DMCA takedown notice to our Designated Agent. To be valid, your notice must include all of the following:
- 1.A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- 2.Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.
- 3.Identification of the material that is claimed to be infringing, including sufficient information to permit us to locate it (e.g., the specific URL).
- 4.Your contact information: name, address, telephone number, and email address.
- 5.A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 6.A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

See the Designated Agent section below for contact information. We only accept notices via email or mail — we cannot process notices sent through social media or chat.
What Happens After We Receive a Notice
When we receive a valid DMCA takedown notice, here's what we do:
- ▸Prompt review: We review the notice to confirm it meets DMCA requirements. Incomplete notices will be returned requesting additional information.
- ▸Disable access: If the notice is valid, we will promptly disable access to or remove the allegedly infringing content.
- ▸Notify the uploader: We will notify the user who uploaded the content that it has been removed and provide a copy of the takedown notice (with your personal contact info redacted if you request).
- ▸Counter-notice window: The uploader may submit a counter-notice within 10–14 business days (see Section 4).
- ▸Restore or keep down: If we receive a valid counter-notice and you do not initiate legal action within 10–14 business days, we may restore the content.
Response time is typically within 3–5 business days for complete notices. For urgent matters involving repeat infringers or clearly illegal content, we act faster.
Counter-Notification Process
If you are a user who believes content was removed due to a mistake or misidentification, you may submit a DMCA counter-notification to our Designated Agent. A valid counter-notification must include:
- 1.Your physical or electronic signature.
- 2.Identification of the content that was removed and the location where it appeared before removal (e.g., the URL).
- 3.A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
- 4.Your name, address, and telephone number.
- 5.A statement that you consent to the jurisdiction of the federal district court in your district (or, if you are outside the US, any judicial district in which Marked Management may be found), and that you will accept service of process from the person who submitted the original takedown notice.
After we receive a valid counter-notice, we will forward it to the original complainant and inform them that we may restore the content within 10–14 business days unless they notify us they have filed a court action to restrain the activity.

Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), Marked Management maintains a policy of terminating accounts of users who are repeat copyright infringers in appropriate circumstances.
- ▸A user who receives 3 or more valid DMCA takedown notices that are not successfully counter-noticed may have their account suspended or permanently terminated.
- ▸Account termination decisions consider context: the severity of infringement, whether it appears intentional or negligent, and the user's history on the platform.
- ▸Users engaged in systematic or deliberate copyright infringement — such as mass uploading content they clearly don't own — may be terminated after a single complaint.
- ▸Terminated accounts for copyright infringement are generally not reinstated.
We track all valid DMCA notices we receive. This tracking is how we identify repeat infringers and maintain DMCA safe harbor protection for the platform.
Misuse of the DMCA Process
The DMCA process exists to protect legitimate copyright interests — not to censor content, suppress competition, or harass users. We take misuse of the DMCA process seriously.
- ▸We may reject takedown notices that appear to be submitted in bad faith or that target content that is clearly fair use, public domain, or not infringing.
- ▸Parties who submit fraudulent takedown notices may be reported to appropriate authorities and may face legal action from affected users.
- ▸If you believe a takedown notice was filed abusively against your content, include this in your counter-notice and we will review the circumstances.
